Why Use One?

Documents are often notarized so that the individual receiving the notarized document can assure himself that the document is authentic for the simple reason that the appropriate individual, in fact executed (signed) the document.

Guidelines for Choosing a Notary

  • Notaries may not necessarily be lawyers, depending on the legal regime in the province you find yourself in.
  • While a real estate lawyer can represent you in court, a Notary can not do that. The job of a notary is restricted to authenticating any paperwork involved and invariably they become legal witnesses when legal issues arise in court.
  • Real Estate lawyers, on the one hand, can provide legal advice on different areas of law if required. Notaries, on the other hand, are restricted to the notary services they provide.

Keep in mind that the original document is notarised to assure anyone receiving or relying on that document that it is authentic.
In some instances, a photocopy of the original document may also be notarised. This simply assures anyone relying or receiving the photocopy that it is a true version of the original copy!

Commissioner of Oaths

  • A Commissioner of Oaths (“Commissioner”) in Alberta must work under the provisions of the Notaries and Commissioners Act.
  • A Commissioner on the one hand cannot work as a Notary Public. However, on the other hand, a Notary can work as a Commissioner.
  • A Commissioner is an individual who can serve as an official witness to a sworn oath or solemn affirmation or declarations on a legal document, most often an affidavit. Affidavits are statements made by individuals and sworn under oath.
  • A Commissioner, while working in that capacity has to print his stamp on every document he signs. The stamp should also have the expiry date of his/her appointment.
